Order 010: Territorial Waters and Border Control

Transitional Government of the Republic of Alduria
ORDER 010

Quote:Pursuant to my authority as President of the Republic of Alduria, and the provisions of the Constitution of Alduria, I hereby promulgate the following:

SECTION I. Definitions.

  1. The baseline is the seaward limits of the Republic of Alduria’s territorial sea and certain other maritime zones of jurisdiction are measured. A sea baseline follows the low-water line of the Republic of Alduria’s coast. When the coastline is deeply indented, has fringing islands or is highly unstable, straight baselines may be used.
    1. A baseline is drawn between the outermost points of the outermost islands, subject to these points being sufficiently close to one another. All waters inside this baseline are designated Archipelagic Waters. Republic of Alduria has full sovereignty over these waters, but foreign vessels have right of innocent passage through archipelagic waters.
  2. Internal waters are defined as all water and waterways on the landward side of the baseline. The Republic of Alduria is free to set laws, regulate use, and use any resource in these waters. Foreign vessels have no guaranteed right of passage within internal waters.
  3. Territorial waters are defined as the 12 nautical miles (22 km; 14 miles) from the baseline. The Republic of Alduria is free to set laws, regulate use and use any resource within these waters. Vessels are given the right of innocent passage through any territorial waters, with strategic straits allowing the passage of military craft as transit passage, if vessels do not maintain offensive postures in these waters.
  4. Innocent passage is defined as passing through waters in an expeditious and continuous manner that is not prejudicial to the peace, good order, stability or security of the Republic of Alduria.
    1. Unauthorized fishing, polluting, weapons practice, spying and resource extraction within these waters are not considered innocent.
    2. Submarines and other underwater vehicles are required to navigate on the surface and show their flag while navigating through territorial waters.
    3. The Republic of Alduria may temporarily suspend innocent passage in specific areas of their territorial seas, if doing so is essential to national security.
  5. Contiguous zone is defined as a further 12 nautical miles from the limit of territorial waters limit in which the Republic of Alduria can enforce laws in four specific areas: customs, taxation, immigration, pollution, and security.
  6. Aldurian waters are defined as including internal and territorial waters.
SECTION II. Aldurian Sovereignty Over Territorial Waters.
  1. The Republic of Alduria hereby asserts its right to declare the baselines, archipelagic waters, internal waters, territorial waters and contiguous zones and extend its sovereignty and all rights and responsibilities thereof over them.
  2. Internal and territorial waters shall be patrolled on a regular basis by the appropriate military branches, whose duty shall be to maintain the territorial integrity of the Republic of Alduria's waters and naval superiority over them.
  3. No foreign military presence shall be tolerated within the Republic of Alduria's internal or territorial waters, unless specifically authorized by the Cabinet or Parliament. Any vessels without authorization shall be detained and impounded unless they depart Aldurian waters within 24 hours with a military escort. Vessels that have informed the Department of Defense prior to passage and have obtained proper permission are exempt.
  4. The Republic of Alduria shall maintain the right to intercept all incoming transmissions through Aldurian waters and search vessels for contraband, illegal substances and weapons. Any vessels not conforming to such searches may be attacked and impounded by patrolling vessels should they fail to comply, their governments then properly notified.
  5. Should military vessels violate Aldurian waters without permission and refuse to leave or comply with the provisions of this Act, the Republic of Alduria may then consider this a causus belli for military action or a declaration of war.
SECTION III. Aldurian Coast Guard.
  1. The Aldurian Coast Guard shall be entrusted during peacetime with the following responsibilities, under the supervision of the Department of Defense:
    1. search and rescue;
    2. enforcement of maritime law;
    3. safety of vessels;
    4. maintenance of seamarks;
    5. maritime border control;
    6. protection of economic interests of the Republic of Alduria and its natural resources within its sea border areas, territorial waters and internal seas, including prevention of poaching and illegal fishing; and
    7. combat any threats to national security in the maritime border areas, including terrorism, illegal immigration and emigration, and foreign infiltration.
  2. The Aldurian Coast Guard may be assigned the following additional duties during wartime by order of the President of the Republic:
    1. harbor defense;
    2. port security;
    3. naval counter-intelligence; and
    4. coastal patrols.
SECTION IV. Aldurian Border Guard.
  1. There shall be an Aldurian Border Guard established under the jurisdiction of the Department of Defense, as part of the Aldurian Armed Forces.
  2. The Aldurian Border Guard shall be entrusted during peacetime with the following responsibilities:
    1. search and rescue;
    2. enforcement of border control and security law;
    3. safety of vessels;
    4. maintenance of border fences and facilities, checkpoints, and access points;
    5. terrestrial border control;
    6. protection of economic interests of the Republic of Alduria and its natural resources within its land border areas, including prevention of illegal hunting, mining or resource extraction;
    7. combat any threats to national security in the border areas, including terrorism, illegal immigration and emigration, and foreign infiltration.
  3. The Aldurian Border Guard may be assigned additional duties during wartime by order of the President or the Secretary of Defense.
  4. The Aldurian Coast Guard serves as a deputized agency of the Aldurian Border Guard and aid the Aldurian Border Guard in the implementation of its mandate. Units of the Aldurian Armed Forces likewise may be deputized by the Aldurian Border Guard for this purpose.
  5. Law enforcement units from the Office of Border Protection may be drafted by the Aldurian Border Guard to serve as deputized agents of the Aldurian Border Guard and aid the Aldurian Border Guard in the implementation of its mandate.
SECTION V. Economic Presence and Natural Resources.
  1. Aldurian waters shall be considered Aldurian territory and their resources are reserved for the use of Aldurian enterprises and companies only. Foreign initiatives must contact the Republic of Alduria to gain access to such materials and pay for the rights to do so.
  2. The usage of raw materials in Aldurian waters shall be placed under the jurisdiction of the Department of Interior, which owns the sole right to issue permits to Aldurian and foreign nationals to extract such raw resources and materials.
  3. The extraction of raw materials and resources without proper permission is illegal and may result in proper legal action against them.
  4. A tax shall be levied on foreign companies and nationals for extracting raw materials within the Republic of Alduria's waters at a flat rate to be established by Act of Parliament or by an executive order from the President that is countersigned by the Prime Minister.
  5. All natural resources are in the locations and amounts set out by the Micronational Cartographic Society's resource maps.
