Transitional Government of the Republic of Alduria
ORDER 016

Quote:Pursuant to my authority as President of the Republic of Alduria, and the provisions of the Constitution of Alduria, I hereby promulgate the following:

SECTION I. Political Parties.
  1. In this Order, the term "political party" means a political party registered under this act.
  2. A political party shall come into existence when its central party is registered with the National Election Commission and inscribed in the Register of Political Parties. No person or group of person shall be regarded as a political party, save subject to conditions prescribed by this Order.
  3. A political party shall exist by virtue of its enrollment into the Register of Political Parties, which shall be administered by the National Election Commission.
  4. The National Election Commission shall register a political party as a major political party, if it is satisfied that the political party:
    1. has at least two members who are citizens of the Republic or at least one member who is member of the Cabinet;
    2. has a leader elected or recognized by a majority of the members thereof;
    3.  has legitimate principles that are inconsistent with those of existing political parties;
    4. has a written constitution declaring its principles.
  5. The National Election Commission shall register a political party as a minor political party, if it is satisfied that the political party:
    1. has at least one member who are citizens of the Republic;
    2. has a leader elected or recognized by the majority of the members thereof;
    3. has legitimate principles that are inconsistent with those of existing political parties;
    4. has a written constitution declaring its principles.
  6. Each political party shall have the right to democratically determine its own symbols, policies, motto, name, or any other issue related to its identity.
  7. All major political parties shall be guaranteed the equal right to their own headquarters.
  8. A political party shall manifest its platform (or basic policies) and party constitution.
  9. The matters falling under each of the following subparagraphs shall be provided for in a political party’s constitution:
    1. The name or title of the political party;
    2. Matters on general organization, composition, and competence of the political party;
    3. Matters on methods of appointment, term, and rights and obligations of the representative and executive members;
    4. Matters on joining and seceding from the party, expulsion of party members, and the rights and obligations of party members;
    5. Matters on the establishment and convocation procedures of the representative organs;
    6. Matters on the composition, competence, and convocation procedures of the executive council;
    7. Matters on the finances of the political party;
    8. Matters on the election of candidates for elected public offices;
    9. Matters on the establishment and amendment of the party constitution and party regulations;
    10. Matters on the dissolution and merger of the political party;
    11. Matters on the disposal of residual assets in cases of revocation of registration or voluntary dissolution.
  10. A political party shall have a representative organ capable of reflecting the consensus of party members in order to maintain its democratic internal order and an executive organization, and a plenary session of parliamentary members where any of the party’s members of Parliament belonging thereto are present.
  11. A political party shall have a budget and accounts committee in order to verify and examine matters concerning the finances of the political party, such as its budget, closing accounts, and auditing, etc. of details thereof.
  12. Composition, competence, and other matters of the organizations referred to in paragraphs 10 and 11 shall be provided for by the party constitution.
SECTION II. Register of Political Parties.
  1. The National Election Commission shall enroll any registered political party into the Register of Political Parties, which shall contain the following data for each political party:
    1. the name of the political party;
    2. an explanation of the principles of the political party;
    3. a copy of the constitution of the political party;
    4. a copy of a current platform of the political party;
    5. a list of legislation or ideas that the political party has endorsed;
    6. a list of the members of the political party (making special note to recognize the leader of the party).
  2. The Register of Political Parties shall be regularly maintained and updated by the National Election Commission.
SECTION III. Advancement, Decline, and Loss of Status.
  1. A minor political party may advance to the status of a major political party if it meets the qualifications of a major political party.
  2. A major political party may decline to the status of a minor political party if it no longer meets the qualifications of being a major political party.
  3. The National Election Commission may at any time remove a political party from the Register of Political Parties altogether if it has failed to fulfill the minimum qualifications of a minor political party.
  4. The legally constituted courts of the Republic may at any time dissolve a political party, if that political party, in the judgement of the Court, develops any activity against the law, peace, or public order of the Republic.
SECTION IV. Existing Political Parties.
  1. The political parties currently known as the National-Liberal Alliance, the New Center, and the National Congress for Social Democracy shall be registered automatically as major political parties, regardless of current qualifications under this Order.
  2. The political parties currently known as the Movement for Alduria, the Liberty and Democracy Party, the Communist Party of Alduria, and the Euran Destiny Party shall be registered automatically as minor political parties, regardless of current qualifications under this Order.
